By using Send a Legal Letter’s (“Us” or “We”) web site or services and whether a product is delivered, individuals and business organizations (“You”) agree with and accept the terms of this privacy policy (“Privacy Policy”).  This Privacy Policy sets forth the terms and conditions concerning the collection and use of personal and business information by Us.

 

Definition of Personal Information: Personal information is information that relates to and is capable of being linked to a particular person, such as given names, nicknames, addresses, online identifiers, Internet Protocol (“IP”) addresses, email addresses, credit card account numbers and other credit card information, landline and cell phone numbers and any information not requested by Us but provided by You.  Generally, We will only collect and use the foregoing personal information reasonably necessary to initiate and complete an order for Send a Legal Letter services and to respond to any appropriate request under applicable law. 

 

Additional Definition of Personal Information under California Law:  Personal information is also information as defined by California Civil Code Section 1798.80(e) as follows: “Personal information” means any information that identifies, relates to, describes, or is capable of being associated with, a particular individual, including, but not limited to, his or her name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health information.  “Personal information” does not include publicly available information that is lawfully made available to the general public from federal, state, or local government records. 

 

Disclosure of Personal Information: We will not distribute or sell your personal information to any third party for marketing or sales purposes.  We do retain records of your personal information for the purpose of response to appropriate requests, such as a subpoena, discovery request in litigation and lawful order by a government entity, including any request in connection with a national security or law enforcement requirement.  You agree not to sue Us if We disclose your personal information under the foregoing circumstances.    

 

We reserve the right to contest or appeal a subpoena, discovery request or government order for your personal information, documents or recordings that contain such personal information if in good faith we believe such request or order is illegal or otherwise inappropriate. 

 

Protection of Personal Information:  We endeavor to ensure that all data and information, including credit card information is secure from viewing and theft by unauthorized persons.  No data can be completely guaranteed secure, notwithstanding our reasonable efforts to avoid unauthorized use of your personal information as well as unauthorized use of any product or service We provide to You through Send a Legal Letter’s website.  WE SHALL NOT BE LIABLE FOR AND YOU AGREE TO HOLD US HARMLESS FROM AND AGAINST ANY LOSS, COST OR DAMAGE ARISING DIRECTLY OR INDIRECTLY FROM ANY INTERCEPTION OF OR UNAUTHORIZED ACCESS TO YOUR PERSONAL INFORMATION, DATA, COMMUNICATIONS AND ANY PRODUCT OR SERVICE WE PROVIDE TO YOU.  YOU EXPRESSLY ASSUME THE FOREGOING RISKS AND AGREE NOT TO TAKE ANY ACTION AGAINST US IN THE EVENT ANY SUCH LOSS, COST OR DAMAGE OCCURS. 

 

Information for California Residents Only:  California allows its residents to request that a business which collects consumers’ personal information access to certain information.  This includes specific information and categories of personal information that the business has collected about the consumer, the categories of sources for that information, the business or commercial purposes for collecting information and the categories of third parties with which the information was shared.    

 

You may submit a request for deletion of personal information under certain circumstances.  This is not an absolute right and We may decline to delete the information such as when We are legally required to retain the information. 

 

How to Request Deletion of or Access to Information:  Please email a request to delete personal information to CustomerService@SendaLegalLetter.com.  Upon receipt We will ask You to verify your email address.  We may also ask for additional information to verify your identity, which may include an affidavit under penalty for false statements.  We will attempt to verify your identity by asking for information that correlates with personal information already in our possession.

 

Confidentiality:  In the course of our work on your behalf, We may view documents, digital communications  and other materials You provide to Us.  We will endeavor to ensure that such materials are not disclosed to other parties.  We may release documents where required by law, such as but not limited to subpoenas, discovery in litigation and administrative law orders.  Please note that our work is not subject to attorney-client privilege.     

 

Changes to this Privacy Policy:  This privacy policy may be updated periodically on an as-needed basis to reflect changes in Send a Legal Letter’s business or applicable law.  If We do make any material changes to this privacy policy, We will post it on this website.

Please read these terms of use (“Terms of Use”) before ordering any product or service from Send a Legal Letter (“Us” or “We”).  By ordering any product or service from Send a Legal Letter, You expressly agree to comply with these Terms of Use and all applicable laws and regulations.  “You” refers to any customer ordering any product or service from Send a Legal Letter.  A customer may be an individual or a business organization.    

 

Services Provided by Send a Legal Letter: Send a Legal Letter is a free service that provides letters drafted by a licensed attorney.  Send a Legal Letter’s product is suitable for communication with other parties  in connection with prospective or existing business or legal matters, utilizing the facts as provided to Us by You.  We provide letters for common matters such as consumer issues, general real estate, landlord-tenant relations, contracts and insurance.  Our services are available for matters among individuals residing in and business organizations domiciled (registered) in the United States.  If for any reason We are unable to service your request, We will notify You as soon as reasonably possible.  Send a Legal Letter’s service is not available if You are in litigation with the other party and may not be available in all states.  We do not provide services where matters may be subject to the laws a foreign nation and we do not handle criminal law matters.    

 

Nature and Scope of Relationship Between You and Send a Legal Letter: Our service is limited to the  letter You contract with us to produce for your use.  We rely on You to provide Us with complete, accurate and truthful statements concerning your matter.  We ask You to provide copies of all relevant documents and digital communications concerning Your matter, in addition to Your recitation of the facts.  We will utilize these materials to provide a customized letter for your use.  You may edit and sign the letter under your own name or have an agent sign in your sole discretion.  Send a Legal Letter is not a law firm and does not provide legal advice.  The relationship between Us and You is only as a vendor and customer and no attorney-client relationship is created.  If You require legal advice, please do not utilize Send a Legal Letter. While we cannot guarantee that Send a Legal Letter will be able to resolve your matter, We will endeavor to present your side of the matter in the best possible light.  We use commercially reasonable efforts to produce accurate letters, but we are not liable for errors or omissions including, but not limited to incomplete or false statements provided by You, omission of material facts by You or changes in applicable law becoming effective after performance of our research and letter drafting.
